Terms of Service

To use AdVibes, you must create an account by providing accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.

You must be at least 16 years old to create an account. If you are creating an account on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent, abusive, or illegal activity.

AdVibes provides an AI-powered marketing platform with tools for content creation, campaign management, asset management, video editing, brand management, and analytics. You may use the Service for lawful purposes in accordance with these Terms.

You agree NOT to:

• Use the Service to generate illegal, harmful, defamatory, or infringing content

• Attempt to reverse-engineer, decompile, or extract our AI models or proprietary technology

• Use automated tools to scrape, mine, or collect data from the Service

• Share your account credentials with unauthorized third parties

• Upload content that violates the intellectual property rights of others

• Use the Service to generate spam, phishing, or deceptive content

• Interfere with or disrupt the Service or its infrastructure

• Exceed your plan's usage limits through circumvention or abuse

Ownership: You retain ownership of content you create using our AI tools, subject to the limitations below. Content you generate using AdVibes AI is yours to use commercially, edit, and distribute.

Limitations: AI-generated content may not be unique to you — other users providing similar prompts may receive similar outputs. We do not guarantee exclusivity of AI-generated content.

Responsibility: You are solely responsible for reviewing, editing, and ensuring that AI-generated content is accurate, appropriate, and compliant with applicable laws before publishing or distributing it.

No Warranty: AI-generated content is provided "as is." We do not guarantee the accuracy, completeness, or fitness for any particular purpose of AI-generated outputs.

Your Content: You retain all rights to content you upload to AdVibes (images, videos, documents, brand assets, etc.). By uploading content, you grant us a limited license to process, store, and display it as necessary to provide the Service.

Compliance: You represent that you have all necessary rights and permissions to upload and use the content you provide. You agree not to upload content that infringes third-party rights.

Backups: While we implement regular backups, you are responsible for maintaining your own copies of important content. We are not liable for data loss.

AdVibes offers both free and paid subscription plans. Paid plans are billed on a monthly or annual basis as selected at the time of purchase.

• Payments are processed securely through our payment provider (PayStack)

• Subscriptions automatically renew unless cancelled before the renewal date

• You may cancel your subscription at any time through your account settings

• Refunds are available within 14 days of initial purchase if you are unsatisfied

• We reserve the right to change pricing with 30 days' advance notice

• Usage limits (AI renders, storage, projects) are defined by your plan tier

Our IP: The AdVibes platform, its design, code, AI models, templates, features, and documentation are owned by Initbod Limited and protected by intellectual property laws. Nothing in these Terms grants you rights to our trademarks, logos, or brand assets.

Feedback: If you provide suggestions, ideas, or feedback about the Service, we may use them without obligation to you.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ADVIBES AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE.

Our total liability for any claim arising from these Terms or the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or secure. AI-generated outputs may contain inaccuracies and should be reviewed before use.

You agree to indemnify, defend, and hold harmless Initbod Limited and its affiliates from any claims, liabilities, damages, costs, and expenses (including legal fees) arising from your use of the Service, your content, your violation of these Terms, or your infringement of any third-party rights.

We may suspend or terminate your access to the Service at any time for violation of these Terms, with or without notice. Upon termination, your right to use the Service ceases immediately. Provisions that should reasonably survive termination (including liability limitations, indemnification, and dispute resolution) will continue to apply.

You may terminate your account at any time through your account settings. Upon account deletion, your data will be removed in accordance with our Privacy Policy.

These Terms are governed by and construed in accordance with the laws of the Federal Republic of Nigeria. Any disputes arising from these Terms shall be resolved through binding arbitration in Lagos, Nigeria, unless otherwise required by applicable law.

We may update these Terms from time to time. We will notify you of material changes by posting a notice on the platform or sending you an email at least 30 days before changes take effect. Your continued use of AdVibes after changes constitutes acceptance of the updated Terms.

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining provisions remain in full force and effect.
